GUARDIANSHIP/CONSERVATORSHIP

We advise all our competent clients to consider signing Advance Directives including a Durable Power of Attorney and Health Care Proxy. These documents permit an individual to appoint a trusted person to make business, financial or health care decisions if the individual is unable to make those decisions or act on their own behalf.

Oftentimes, however, those documents are not in place and if an individual unexpectedly loses capacity due to dementia, mental illness or some other unforeseen event, the only recourse available to help that individual is for a trusted individual or family member to institute a proceeding for guardianship (for the ability to make decisions about the person’s day to day life) or for conservatorship (for the ability to make decisions about the person’s financial affairs).
